Welcome to Moms Making Memories ("Plan Ahead Mom")! By accessing our content, signing up for our email list, downloading our free resources, using our affiliate links, purchasing our products, or engaging with any of our services (including coaching) you agree to be bound by these Terms & Conditions and consent to our Privacy Policy. Please read them carefully before engaging with our content or services.

If you do not agree with any part of these terms or our Privacy Policy, please do not use our content or services.

These Terms & Conditions apply to all products and services offered by Moms Making Memories LLC ("Plan Ahead Mom"), including:

  • Free lead magnets and downloadable resources
  • Email list and communications
  • Amazon Influencer storefront and Amazon affiliate links
  • Digital products and courses
  • Coaching services (1:1 calls and async communication)
  • Social media presence (TikTok, Instagram, YouTube, Facebook)
  • Our website and sales pages
  • DM communication (Instagram, Facebook, and TikTok)
  • Any future offerings

  1. PURCHASE TERMS

Digital Products & Courses

When you purchase a digital product or course from Plan Ahead Mom:

  • Payment must be completed in full (or as according to payment plan) before access is granted
  • You will receive access to your digital products or course via email or directly through Kajabi upon successful payment
  • You should download and save any downloadable files immediately upon receipt
  • We cannot guarantee future access to previously purchased digital products, so please save your downloads in a secure location
  • All digital product sales are final due to the instant, downloadable nature of digital goods unless otherwise noted at the time of purchase

Coaching Services

When you purchase coaching services from Plan Ahead Mom:

  • Payment must be completed in full before coaching sessions or async access begins
  • Coaching is delivered via live video or phone calls (such as Zoom) and/or asynchronous communication (such as email or voice messages), as outlined in your specific coaching package
  • Session scheduling is subject to availability and will be coordinated directly with you
  • You are responsible for showing up to scheduled sessions on time and prepared
  • Missed sessions without at least 48 hours notice may be forfeited at our discretion
  • Coaching packages are non-transferable and may not be shared with others

Note: Coaching clients will be provided with a separate Coaching Agreement prior to beginning services. In the event of any conflict between these Terms & Conditions and a signed Coaching Agreement, the terms of the Coaching Agreement shall control with respect to coaching services specifically.

Free Resources

Our free lead magnets and downloadable resources are provided at no cost. By requesting a free resource, you agree to join our email list and receive communications from Plan Ahead Mom. You may unsubscribe at any time.

  1. REFUND AND CANCELLATION POLICY

Digital Products & Courses

Due to the instant, downloadable nature of digital products, all sales of digital items are final (unless otherwise noted at the time of purchase). Once payment is processed and you receive access to the digital content, we are unable to offer refunds. We encourage you to review all product descriptions carefully before purchasing.

Coaching Services

Due to the time and preparation involved in coaching, the following refund policy applies:

  • Coaching packages are non-refundable once a session has been completed or async communication has begun
  • If you choose to discontinue coaching before any sessions have taken place or async communication has begun, you may request a refund within 24 hours of purchase
  • Refund requests after 24 hours of purchase will be evaluated on a case-by-case basis and are not guaranteed
  • We do not offer partial refunds for unused sessions within a package

INTELLECTUAL PROPERTY RIGHTS

Ownership

All content, materials, products, and resources provided by Plan Ahead Mom are the exclusive intellectual property of Moms Making Memories LLC and are protected by copyright, trademark, and other intellectual property laws. This includes but is not limited to:

  • Free lead magnets and downloadable resources
  • Digital products and course materials
  • Coaching materials, frameworks, and resources shared during coaching
  • Website content, graphics, and branding
  • Social media content, videos, and captions
  • Email content and templates

Permitted Use

You are granted a limited, non-exclusive, non-transferable license to:

  • Use digital products and free resources for personal, non-commercial use
  • Implement strategies and ideas from our resources in your own life and home
  • Share printed materials with members of your immediate household

Prohibited Use

You may NOT:

  • Share, redistribute, resell, or sublicense any Plan Ahead Mom content, products, or materials
  • Use any Plan Ahead Mom content for commercial purposes without explicit written permission
  • Copy, reproduce, or create derivative works based on our content or materials
  • Remove copyright notices or branding from any materials
  • Record, screenshot, or redistribute coaching sessions or materials without written consent
  • Post or share coaching materials, frameworks, or resources in public forums or social media

  1. AFFILIATE LINKS AND DISCLOSURES

Amazon Influencer & Amazon Associates Program

Plan Ahead Mom participates in the Amazon Associates Program, Amazon Influencer program and Amazon Influencer storefront. This is an affiliate advertising program designed to provide a means for us to earn fees by linking to Amazon.com and affiliated sites.

When you click on an Amazon affiliate link or a link in our Amazon Influencer storefront and make a purchase:

  • We may earn a small commission at no additional cost to you
  • Your purchase price remains the same whether you use our affiliate link or go directly to Amazon
  • We only recommend products we genuinely believe will be helpful
  • Amazon handles all payment processing and order fulfillment

Maximum Liability

Moms Making Memories LLC’s (β€œPlan Ahead Mom”) total liability for any claim arising from your use of our products or services will not exceed the amount you paid for the specific product or service in question.

No Liability For

Moms Making Memories LLC (β€œPlan Ahead Mom”) will not be held liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of time, productivity, data, or opportunities
  • Decisions made based on information provided in our resources, content, or coaching
  • Outcomes or results from implementing strategies from our content or coaching
  • Technical issues, platform downtime, or loss of access to digital products
  • Actions taken by third-party platforms (Kajabi, Stripe, PayPal, Amazon, social media platforms, etc.)

Third-Party Services

We are not responsible for:

  • Actions, policies, or services provided by third-party platforms
  • Payment processing issues
  • Social media platform changes or account suspensions
  • Changes to affiliate programs or commission structures

  1. USER RESPONSIBILITIES

If Plan Ahead Mom offers community spaces in the future (such as a Facebook Group or membership community), the following guidelines will apply. Participants agree to:

  • Engage in constructive, supportive conversations
  • Not share exclusive content outside the community
  • Not screenshot or record content from private community spaces
  • Refrain from spam, self-promotion, or unauthorized advertising
  • Respect the privacy of other community members

Plan Ahead Mom reserves the right to remove any content or member that violates these guidelines, at our sole discretion.

  1. MODIFICATIONS TO TERMS

Plan Ahead Mom reserves the right to modify these Terms & Conditions at any time. Changes may be made to:

  • Reflect changes in our products, services, or business practices
  • Comply with legal requirements or industry standards

Notification of Changes

We will notify you of material changes by:

  • Posting the updated Terms & Conditions on our website

Your continued use of Plan Ahead Mom products and services after changes are posted constitutes your acceptance of the updated Terms & Conditions. If you do not agree with the updated terms, you may discontinue use of our services.

  1. TERMINATION

Your Right to Terminate

You may discontinue your relationship with Plan Ahead Mom at any time by ceasing to use our content and services and unsubscribing from our email list.

Our Right to Terminate

Plan Ahead Mom reserves the right to terminate or suspend your access to our products, services, or coaching:

  • For violation of these Terms & Conditions
  • For abusive, fraudulent, or disrespectful behavior toward us or our community
  • For chargebacks or payment disputes
  • At our sole discretion for any reason

Termination may result in immediate loss of access to purchased products or services without refund, subject to the refund policy outlined in Section 3.

  1. DISPUTE RESOLUTION AND ARBITRATION

If you have a complaint or encounter any issues, please contact us first at [email protected]. We will make every effort to resolve the matter directly and in good faith.

If we are unable to resolve the dispute through direct communication, you agree to submit the dispute to binding arbitration before a mutually agreed-upon arbitrator, administered by a recognized arbitration body as selected by Plan Ahead Mom (such as the American Arbitration Association or a similar organization), in accordance with that body's rules. In the event that the selection of an arbitrator is not agreed upon, you agree to submit the dispute to binding arbitration before an arbitrator selected by Plan Ahead Mom. By agreeing to this term, you acknowledge that you are waiving your right to a jury trial in court.

The only potential award available to you is a refund of any payment made to Moms Making Memories LLC (β€œPlan Ahead Mom”) for the applicable product or service. You are not eligible to seek additional damages, including consequential or punitive damages.

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Ohio and the United States, without regard to conflict of law principles.

  1. NO CHARGEBACKS

You may not, under any circumstances, issue or threaten to issue a chargeback to your credit card, debit card, or payment provider for any purchase made through Plan Ahead Mom, including coaching services, digital products, or any other offering.

If you have a concern about a charge, please contact us directly at [email protected] before initiating any dispute with your bank or payment provider. We are happy to work with you to resolve any legitimate concerns.

If you initiate a chargeback, Plan Ahead Mom reserves the right to:

  • Immediately terminate your access to all products, services, and coaching without refund
  • Pursue recovery of the disputed amount through collections or legal action
  • Report the matter as a delinquent account where applicable

  1. SEVERABILITY

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and Moms Making Memories LLC (β€œPlan Ahead Mom”) regarding your use of our products and services. These terms supersede any prior agreements, communications, or understandings, whether written or oral.
